Economic requirements to obtain a TIE as a British citizen who wants to reside and work in Spain if he/she didn’t have a registration certificate (until 31 December 2020)

Page 7 of the Instruction of 2 July 2020 on Brexit refers to Article 3 of Order PRE/1490/2012 of 9 July, and states that a British person who is not working for somebody else or self-employed must prove sufficient resources,  and in addition,

The assessment of economic sufficiency shall be carried out on an individual basis, and in any event, taking into account the personal and family situation of the applicant.

The holding of resources greater than the amount set by the Law on General Budgets of the State to generate the right to receive a non-contributory benefit, taking into account the personal and family situation of the person concerned, shall be considered sufficient accreditation for the fulfilment of this requirement.

For example, by 2020 standards as of yet the State Budget for 2021 hasn’t been approved, it is required to prove 75% of the Interprofessional Minimum Wage.

The SMI 2020 is EUR 13,300 per year.

75% is 9974 euros per year.

Doubt arises as to whether the Administration will multiply that amount by 5, as the TIE of the Withdrawal Agreement (Brexit) lasts 5 years. In such a case, EUR 49,875 should be established, which I find unreasonable since the applicant may well find work at any time during his residence.

Finally, it should be noted that the standard states that the assessment of media adequacy should be carried out on an individual basis. That is, these limits may not apply on a case-by-case basis.
